A LATE night town centre brawl which left three men with broken bones and a head wound started after a pubgoer was tripped up, a court heard.

Teenage brothers Jack and Daniel Conway were given suspended prison sentences and banned from Bury town centre after pleading guilty to affray and Danielle Johnson, who also admitted the same charge, was handed a community sentence.

Simon Blakebrough, prosecuting at Bolton Crown Court on Friday, said Daniel Conway, aged 18, and his 19-year-old brother Jack, were in a group which included 21-year-old Johnson at Yates’ pub in Bury town centre on the evening of January 31.

Mr Blakebrough told how Jack Conway was tripped up by Kieron Davies and the two men argued, resulting in Conway being ejected from the bar by security staff.

Afterwards Johnson confronted Mr Davies and punched him three or four times after he made an offensive gesture to her. She too was thrown out of the pub.

Fifteen minutes later, as Mr Davies and his group, which included David Page and Ryan McManus, left the pub and walked down Bolton Street, they were approached by the Conways and Jack Conway punched Mr Davies in the face.

Mr Blakebrough said a brawl ensued during which Daniel Conway was seen to kick a man in the head.

The fighting left Mr Davies needing stitches to the face and scalp, Mr McManus suffered a broken left elbow and Mr Page, a fractured collar bone.

The court was told that Daniel Conway, an apprentice chef, of Fir Street, Ramsbottom, was remorseful and the incident had been an isolated one.

Carolyn Smith, defending Jack Conway, also of Fir Street, said he had a problem with binge drinking Daniel Calder, representing Johnson, said she was not responsible for any of the injuries suffered by the victims, but she had been drinking and was ashamed of her actions.

Sentencing the brothers to four months in prison, suspended for 12 months, Recorder John Benson QC told them: “This sort of disgraceful behaviour cannot go unpunished and cannot be taken lightly.”

The brothers were also banned from entering Bury town centre between 9pm and 6am for four months and must each pay £500 prosecution costs and £80 victim surcharges.

Additionally Daniel Conway was ordered to do 120 hours unpaid work, with Jack Conway doing 140 hours unpaid work and attending a behaviour control programme.

Recorder Benson told Johnson, of Poplar Grove, Ramsbottom, that she had been provoked but her reaction was disproportionate.

She was given a six-month community order and told she must attend a women’s offender programme as well as paying £100 prosecution costs and a £60 victim surcharge.
