Reprieve for deportation flights couple

THE deportation of a Bury couple fighting to stay in the UK was halted at the eleventh hour.
Bernard Batey and Lydia Besong, of Kestrel Drive, had been booked seats on flights from Heathrow Airport to Cameroon, via Paris, on Saturday morning.
It looked to be the end of their battle to remain in the country after fleeing Cameroon in 2006, claiming they were persecuted for their involvement with a political pressure group.
But Judge Mark Pelling QC, sitting in Manchester last Thursday, approved applications to stop the flights and for a judicial review to be held.
The Home Office appealed against the decision, but lost the case when it was heard at 5pm on Friday and was ordered to pay costs.
The couple’s solicitor, Gary McIndoe, said: “It’s an excellent result. It’s a battle won but we have a war to fight.”
Yesterday Mr Batey and Mrs Besong were released from Yarl’s Wood Detention Centre and allowed to return home to Bury.
Supporters had been lobbying for Mrs Besong to be allowed out of the centre to attend an urgent appointment at Manchester Eye Hospital for treatment for glaucoma.
A date has not yet been set for the judicial review, though it is expected to be held within a few weeks.
A UKBA spokesman said: “The UK has a proud record of offering sanctuary to those who need it, but where we and the courts have found they do not qualify for protection they must return to their home country.”

This quote is a joke! The Courts do not get a say in most asylum applications! Decisions are made by a single, caseworker alone! There is no panel involved, no team of individuals from various backgrounds who scrutinise each application. Decisions are made in secret by the UKBA caseworker who takes the initial interview of the asylum seeker and the caseworker alone decides who stays and who goes.
The ONLY time that the Courts and UK Legal system become involved is when an asylum application is refused by the UKBA and the applicant applies to the Court for a Judicial Review but this is a very long, expensive process and many cases never reach the Judicial Review stage and when they do then UKBA has the gall to try and 'negotiate' with the Judicial Review Unit to have the Court hearing withdrawn! I have written proof of this tactic.
If the COURTS truly did hear EACH and EVERY case and we had a decent, clear and transparent system for dealing with asylum claims then the system would be quicker, justice would be done for those who are genuine and the cost to the tax payer would be significantly reduced.
The whole processing system of asylum seekers needs a radical overhaul before can truly be claimed to be fair and just.
At the moment it is appears to be run on the whims of a few which in turn are controlled and guided by government targets and quotas. TRUE and JUST asylum investigations cannot be honestly or legally decided upon under the current system, that is why it is failing: failing the UK tax payer and failing genuine asylum seekers.
CHANGE THE SYSTEM: MAKE IT FAIR, TRANSPARENT AND JUST. MAKE IT ACCOUNTABLE TO UK RESIDENTS & TAXPAYERS AND NOT TO UKBA OFFICE STAFF WHO HIDE BEHIND CLOSED DOORS.
What qualifications who these caseworkers need? So they specialise in particular countries? Do they speak any other language other than English? What does it take to become a UKBA asylum caseworker???

Amma63. I've been reading these post for a few days. I don't think the judicial system is capable of looking at every single case. I think the system is under strain just coping with everyday cases. I think the UKBA are doing the best they can with the money and resources they have. I think you would be better sending your views to a national paper. Lastly I think people are getting bored of your rants now. There's such a thing of scoring a PR own goal and you've just scored one.

I think we need to get rid of alot of the narrow minded, ignorant and unintelligent people like Pauline and her low life friends who come on here and spit there evil.
This country is riddled with these people who tarnish our great country.
A country built on freedom and equality for all!!

What a load of tosh none of these comments have much to do with this couple's plight.I'm sure this couple have already pleaded with the court of human rights in Strasbourg and like many others who make Britain their home will fight tooth and nail to stay here.We have become a dumping ground for all and sundrie.I'm all for multicultural society but not where it is to the detriment of the indidenous population.We need to retain our values and show to the world that we are not soft,weak and patronising to people who try to break in to our country.I have no time for illegal immigrants they take a chance and half are rounded up.There should be no leave of appeal if found theyshould be placed promptly on a plane to where they came.

I am at the same time absoloutly disgusted of the manner you have all commented on.. You are a disgrace to your country and yourselves by lowering yourselfs to such a level.

This woman has obviously lied about her need for asylum, we can tell this by her recent "need" for an eye appointment. They will do anything to avoid going back to Cameroon when they can milk our benefits system.
It is absoloutly outragoues how people have rallied agaisnt thier own country for these people whom are desroying the country.
The UKBA need to deport these people before more africans try to sneak there way in here.
