An officer who threatened to 'make something up' in order to arrest a man will face a misconduct meeting with his own force after an external investigation into his conduct ended.

The IOPC (Independent Office for Police Conduct) wound up its investigation into the officer's behaviour, over an incident in Lancashire last year, when the officer was filmed on a mobile phone.

The officer was suspended from duty on April 20 while the IOPC carried out its enquiries, but upon conclusion, was reinstated and was back on duty at the end of December.

However, the IOPC said the officer now has a 'case to answer' for misconduct and will face a misconduct meeting with Lancashire Police.

This means he cannot be dismissed from his position and can only be given a final written warning as the severest form of punishment.

A second officer who was under investigation over an allegation that he did not challenge or report the conduct of the first officer has been cleared.

A spokesperson for the police said: "The officer involved was reinstated at the end of December.

"No date has been set for any misconduct meeting."

On April 17 2020, police approached four men on Coach Road in Accrington, before an altercation ensued between one officer and a young man, which was filmed on a mobile phone.

It was during the first coronavirus lockdown when people from different households were banned from mixing and one of the men had just bought a motorbike.

In the mobile phone footage, the young man is heard saying: "You're harassing me, what for I've done nothing wrong."

The officer then says: "Do you want me to show you the definition of harassment? Sit in the car and shut up.

"If you want to f******g step to me then fine I will lock you up.

"I will make something up. Public order, squaring up to a police officer, shall I do that?

"Who they going to believe, me or you?"

Footage of the exchange was widely circulated on social media and as result, on April 20, the police referred the matter to the IOPC.

A spokesperson for the IOPC said: “Our investigation into an incident in Coach Road, Accrington, involving an altercation between a police officer and a member of the public is now complete.

“We have referred our findings to Lancashire Police, who agree that one of the officers we investigated has a case to answer for misconduct.

"We found there was no case to answer for another officer we investigated.

“A misconduct meeting will be scheduled by the force in due course.”
