A BURY man who assaulted a pub landlord by smashing a pint glass onto his face after being caught urinating outside once he had been asked to leave has been spared jail because of his previous good character.

Manchester Minshull Street Crown Court heard dad-of-two Kane Hurley entered The Robert Peel with his daughter and troubled emerged when he went behind the bar to pour his own pint.

Landlord Stephen Elliot turned up later and asked him to leave, refunding him for drinks he had bought.

Later the publican left the premises, thinking Hurley had left, only to find him urinating outside.

He shouted at him and prodded him out of disgust at what he was doing. Hurley then smashed a pint glass into his face.

The 31-year-old, of Clifton Road, Prestwich, who admitted to wounding, was given a 10-month suspended prison term and ordered to pay Mr Elliot £1,000 in compensation.

Prosecutor Lisa Boocock said: “Mr Elliot....had a laceration to the side of his face and ear. It is difficult to tell how many stitches, it is a least six, it maybe more.

“He was concerned there would be a permanent scar. Happily for Mr Elliot it seems there is no permanent injury, there is a mark but it has significantly improved.”

Katherine Pierpoint, defending, said: "Drink is no excuse, it is an aggravating factor, it may be explained by his grandmother being unwell at the time.

“There is no suggestion he waited outside for the complainant. The complainant accepts he was poking him and he falls over, he says he wishes he hadn’t dealt with it in this way.”

She said he was the “main breadwinner” for his two young children and had a job in construction.

She added: “In my submission this a man you will not see before this courts again.”

Judge Tina Landale said: “You smashed a pint glass into the side of Mr Elliot’s face.

"It is unbelievable because until August 2019 you hadn’t put a foot wrong.

“You are highly thought of and this is unbelievable. I don’t know why you did it, you don’t know why you did it. Thankfully there is no permanent scarring."
